"Serbia is obviously the motherland for local Romanians. However, the source country according to ethnic, ethno linguistic, spiritual and historical issues, which synthesizes existence and Romanians anthropological heritage, is Romania, known as VALACHIA in history. Many people are not fond of this, including some Romanians. Besides, when we identify ourselves ethnically, is it a physical or spiritual category, or both.

DECISION

1. The Federation of Romanians in Serbia is registered into Citizens associations register, which is listed at the Ministry for human and minority rights, as citizens association, on registry paper no. 3042, under no. 8552

2. The Federation of Romanians in Serbia central office is in Negotin, 12. septembra broj 5.

3. Federation of Romanians in Serbia is represented by Predrag Balasevic, Dragomir Dragic and Jovan Pejkic, FRS co presidents, and Dusan Prvulovic, FRS secretary.

Annotation

Federation of Romanians in Serbia from Negotin sent application for recording into Citizens associations register which is listed at the Ministry for human and minority rights.

While deciding on received application it was confirmed that all conditions requested by the Law are satisfied so it was decided as above Decision says.

STATUTE
Federation of Romanians in Serbia

I Introductory definitions

Object of Statute

Article 1

Federation of Romanians in Serbia (FRS) Statute declares the organization, aims and the way of working, members’ rights and obligations, and other significant issues for FRS.

FRS Aims

Article 2

FRS is citizens association within Romanian community, and every interested organization or individual can join it by accepting and signing the Declaration of FRS founding, and Romanian ethnical community (national minority) program document.

FRS Activities

Article 3

FRS is being founded with the goals to improve work of members, creating consensus in segments of implementing Romanians rights and freedoms in Serbia, together with creation of Romanians ethnical community synergetic efficiency through use of its potentials. All will be done in parity with general European Union principles, accepted and implemented in the Constitution and legislation of Serbia and Montenegro, and of Serbia.

Article 4

The work of FRS will take a path in coherence with existing laws on:

  • Founding representative republic and municipal institutions.

  • Establishing suitable level and quantity of learning Romanian language in school, from dialect to literary convention. This will be adjusted to existing double ethnonimy (bilingual) of Romanians and it will be based on the National Council of Romanian ethnical community (national minority) decisions.

  • Implementing the use of language in mass-media, newspapers, and public services at a needed level.

  • Creating conditions for implementing the use of language in mass service, for members of Romanian community whose mother language is Romanian language.

  • Supporting condition that the state institutions should finance above needs, according to the mechanisms in parity with law.

Article 5

FRS’s special segment of work is preserving environment together with sustainable development without ecological losses, and remediation of great ecological and regional destruction from the past, mostly in regions inhabited by Romanian community. The state will have precise obligations as successor in that area based on positive law rules.

Promotion and representation

Article 6

FRS is promoted and represented by 3 co presidents and the Council’s secretary.

Name, address, seal and logo

Article 7

Full name of FRS is The Federation of Romanians in Serbia.
FRS central office is in Negotin.

The seal has a circle shape with a top title:
Federation of Romanians in Serbia, bottom title: Negotin, and in the middle is FRS logo.
The FRS
’s logo is Romanians archaic symbol for language (grid with 5 horizontal and 7 vertical bars) color dark blue on light blue background with title: FEDERAŢIA RUMÂNILOR DIN SÂRBIE.
FRS will officiate their activities on territory of Serbia and Montenegro.

II Membership

FRS Members and membership

Article 8

Organizations and individuals can join FRS on their free will according to Article 2.

Article 9

FRS Members accept the membership as obligation to act according to basic European principles in their activities from Article 3, without other restrictions on sovereignty and decision making based on their own founding acts and program decisions.

III FRS Organs

Article 10

FRS operates through Assembly, FRS Council, FRS Ethical Council, and FRS Supervising Organ.

FRS Assembly

Article 11

Organizations that are members of FRS have 5 delegates who represent them in Assembly. Citizens represent themselves. The work of Assembly is based on the Rules of Procedure (adopted on Assembly sessions) which defines content, form and way of work and decision making process.

Article 12

FRS Assembly has annual sessions.
FRS Council calls for a session. In special circumstances exceeding session is held on demand of 2/3 of all members.
Assembly work is public by all means.

Assembly makes decisions with majority of more then 1/2 of all members. Only decisions based on Ethical Council opinions are made by simple majority of total Assembly membership.

Article 13

Assembly:

  • Looks over Council’s activities report and makes decisions about priority and gives recommendations for the work of Council.

  • On Ethical Council suggestions the Code of conduct is ratified as well as eventual changes to FRS Code.

  • Chooses the FRS Council.

  • Can start law initiatives for issues of FRS interest.

FRS Council

Article 14

FRS Council is representative organ which consists of 11 members with 2 year mandate.
FRS Council on their sessions examines issues of interest and needs which caused FRS founding. The Council also initiates public discussions to achieve FRS goals, defines the way of FRS joint interest protection, monitors society changes, and responds quickly on issues related to Romanians community and their cooperation with environment. The Council negotiates about cooperation with state and local government, businessmen, syndicates and others.
The Council
calls for FRS Assembly.
The Council chooses, from it
s members, 3 co presidents of FRS Council and appoints the secretary of the Council.
The Council, if needed, can form specialized workgroup.
The Council prepares work report for FRS annual Assembly.
The Council can make decisions only if more then 1/2 of Council members are present.
The Council decisions are made by simple majority. If there is a conflict within members on some issue, the Council makes best decision in accordance to good practice principles.

Article 15

FRS Council adopts the FRS Code and on FRS Ethical Council recommendations based on the Code can discharge members from FRS.
The Council is obligated to inform public and all FRS members about that decision.

FRS Ethical Council

Article 16

FRS Ethical Council is the organ that checks if work is carried out according to the Code.
The Assembly chooses FRS Ethical Council which consists of 9 distinguished public persons. FRS Ethical Council members mandate is 2 years.
Ethical Council chooses the chairman.
The chairman calls for Ethical Council session on his own decision, on demand from 1/3 of members, on demand from FRS Council, and on demand from at least 5 organizations and 25 people that are members of FRS.
Ethical Council makes their decisions by simple majority in form of recommendations and public announcements.
Ethical Council recommendations must be verified by the FRS Council.

Supervising organ

Article 17

Supervising organ consists of 3 individuals and one of them is chairman, elected on Constitutional Assembly.
This organ has 2 years mandate and it is chosen by Assembly.
The function of the Supervising organ is to perform internal control of FRS Council work related to finance operations and to see if it is done according to the Law.

IV Connecting with same or similar organizations in country and from abroad

Domestic organizations

Article 18

FRS will cooperate in their work with all similar organizations from Serbia, and also from Serbia and Montenegro territory.

International organizations

Article 19

On behalf better of results in achieving goals, FRS can establish contact with similar organizations from abroad. FRS can join international organizations after Assembly reaches such decision based on FRS Council proposition.

V Financing

Article 20

Finance and material means for working, FRS gets only from: donations, personal contributions and legacies.
FRS Council will obligate members for gathering finance and material means.
Financial affairs for FRS may be managed by profit organization (for gaining their own profit) which founders are FRS members. The Assembly will decide this.
FRS Council reports about financial affairs to FRS Assembly.

 VI Transitional and closing regulations

Statute Adoption

Article 21

Every member of FRS has the right to propose the Statute.
The proposition must be given in writing.
The proposition must be given to the FRS Council at least five days before Assembly session where it will be discussed on proposition. The FRS Council is obligated to distribute proposition to all Assembly delegates at least 3 days before Assembly session regarding proposition.
The FRS Assembly adopts the Statute of FRS on sessions with majority of more then 1/2 Assembly members.
Statute changes and amendments are made according to adopting procedure.

Article 22

FRS is registered in books according to the Law as citizens association.
Eventual conflicts that can not be resolved by FRS organs or procedures anticipated by the Statute will be given to relevant local Court of Law depending on type of conflict.
If FRS stops working, all finance left will be equally distributed to Romanians Cultural-Educational Centers or institutions which do research on Romanian traditional heritage. These organizations must be on territory where Romanians ethical community exists.

Taking effects

Article 23

The Statute is taking effect from the day of adoption from FRS Constitutional Assembly and it will be used from the day when registered at authorities.
